These Terms and Conditions ("Terms") govern your use of the Auctix website (the "Site") and any services, content, or products provided by Auctix ("Company," "we," "us," or "our"). By accessing or using our Site, you agree to be bound by these Terms.

Unless otherwise indicated, the Site and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") are owned or controlled by us and are protected by United States copyright and trademark laws. Any specific engagement for professional services will be governed by a separate Master Service Agreement (MSA) or Statement of Work (SOW). The information on this Site is for informational purposes and does not constitute a binding offer of services.

5. LIMITATION OF LIABILITY

In no event will Auctix, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit or lost data, arising from your use of the Site. To the maximum extent permitted by US law, our liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to us.

6. INDEMNIFICATION

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Iowa, without regard to its conflict of law principles. Any legal action of whatever nature shall be brought in the state or federal courts located in Pottawattamie, IA.
